TERMS OF USE AGREEMENT
Subject
1.1. Medical Voyage agrees to assist in organizing services (hereafter referred to as final services) that will be directly delivered to the Client by third-party providers (such as clinics, medical professionals, etc.). The services that Medical Voyage provides (hereafter referred to as services) are outlined in Section 1.2. The Client agrees to pay Medical Voyage the agreed-upon fee for these services.
1.2. The services provided by Medical Voyage include:
Arranging online consultations with the selected clinic or medical specialist.
Scheduling in-person consultations at the clinic
Booking the selected medical treatment with the clinic.
1.3. Any other services not listed above may be arranged for an additional fee upon mutual written agreement.
1.4. The Client agrees to cooperate fully with Medical Voyage, providing timely and accurate information as needed for the execution of the services. When marked urgent, information must be provided within 2 business days.
1.5. Medical Voyage reserves the right to choose the best method of delivering services, including the right to involve third parties when necessary. The Client will be informed of any such changes as soon as possible.
Service Price and Payments
2.1. The fee paid covers only the services provided by Medical Voyage and does not include the cost of final services (e.g., clinic fees, medical procedures). These must be paid separately by the Client, either directly to the providers or to Medical Voyage, if agreed in advance.
2.2. Payments must be made via bank transfer to the account provided, within 14 days of receiving this agreement, and no later than two weeks before the Client’s treatment begins.
2.3. If the Client cancels more than 14 days before the scheduled treatment, 100% of the payment will be refunded.
2.4. If the cancellation is made 7–14 days before treatment, 50% of the payment will be refunded (excluding bank fees).
2.5. Cancellations made less than 7 days before treatment will not be refunded.
2.6. In case of force majeure or unexpected circumstances, both parties will agree in writing on how to resolve the payment situation.
2.7. Additional fees will only apply if Medical Voyage can prove that they were unforeseeable and necessary to complete the service.
**2.8. Late payments are subject to a 0.3% daily interest fee for each overdue day.
Liability
3.1. Each party is responsible for any losses caused by non-performance of obligations. However, the liability of Medical Voyage is limited to the amount paid for their services.
3.2. The Client understands that Medical Voyage is not the provider of final services. It only facilitates the connection between the Client and service providers. Therefore:
Medical Voyage is not liable for issues related to the clinic or treatment process.
All complaints regarding the final services must be addressed to the relevant provider.
Medical Voyage does not assume responsibility for medical treatments, surgeries, diagnostics, or their outcomes.
If post-treatment complications arise, they are to be resolved directly between the Client and the medical provider.
3.3. If treatment is not successful or complications occur, Medical Voyage is not responsible for additional costs.
3.4. If unexpected services (e.g., extended hospital stay or post-op care) are needed, Medical Voyage holds no financial liability.
Dispute Resolution
4.1. Disputes will first be resolved by mutual agreement.
4.2. If that fails, legal proceedings will take place under the laws
Validity and Termination
5.1. These Terms come into effect once signed and remain valid until all obligations are fulfilled.
5.2. The contract can be terminated by mutual consent or by the Client with 1-day written notice.
5.3. If terminated, the Client agrees to pay for services already rendered and cover expenses incurred by Medical Voyage.
5.5. Both parties are exempt from obligations in cases of force majeure, as defined by Lithuanian law.
5.6. Notice of force majeure must be given within 1 business day of becoming known
5.7. Communication shall be conducted via registered mail, fax, email, or in-person delivery.
5.8. The Client must notify Medical Voyage of any change in contact details within 1 business day.
5.9. If any part of this agreement becomes invalid, it will be replaced with a clause that reflects the original intent without invalidating the rest of the contract.
5.10. By signing, the Client confirms they have read, understood, and agreed to these Terms freely and voluntarily.
